These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Moore Digital Holdings LLC ("Company," "we," "our," or "us") governing your use of the Friendly Wager iOS application and iMessage extension (collectively, the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Friendly Wager is a social entertainment application that allows users to create, share, and track friendly, non-monetary wagers on sporting events with friends through Apple iMessage and a companion iOS app. The App provides:
The App does not process payments, offer in-app purchases, or settle wagers automatically from game scores.
Friendly Wager does not facilitate, process, or enable real money gambling of any kind.
The App is designed purely for entertainment and friendly social competition. Any stakes agreed upon between users are informal, non-monetary, and exist entirely outside the App. Examples of permissible stakes include bragging rights, buying a meal, or other casual friendly arrangements.

Using the App for real money gambling is strictly prohibited and constitutes a material breach of these Terms.
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that:
If you are accessing the App from a jurisdiction where social wagering applications are restricted or prohibited, you are solely responsible for compliance with local laws.
The App uses anonymous authentication — you are not required to provide an email address, phone number, or any other identifying information to create or join a wager. An anonymous user ID is automatically generated when you first use the App.
You may optionally choose a display name and select favorite teams. You are responsible for the name you choose and agree not to select a name that is offensive, misleading, or infringes on third-party rights.
You may also optionally link your account using Sign in with Apple so your account and wager history persist across devices and reinstalls. Sign in with Apple is not required to use the App.
Your anonymous account and associated data are tied to your device. You can delete your account at any time from the Profile screen in the App, or by contacting us if you can no longer access the App. If you delete the App without first deleting your account, your anonymous account may persist in our database. See our Privacy Policy for details on what deletion removes and what remains.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
We reserve the right to terminate access for any user who violates these prohibitions.
You are solely responsible for the wager content you create, including matchup descriptions and stakes text. By creating a wager, you represent that the content is lawful, does not infringe third-party rights, and complies with these Terms.
We do not pre-screen wager content but reserve the right to remove content and suspend accounts that violate these Terms or applicable law.
Wagers are settled manually by the people involved — the App does not determine winners or use game scores to settle bets. The wager's creator declares the winning side, and the other participants confirm or dispute that result. You acknowledge and agree that:

The App and all of its original content, features, functionality, branding, and design — including but not limited to the Friendly Wager name, logo, graphics, and software — are the exclusive property of Moore Digital Holdings LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the App, or use the App's branding without prior written consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOORE DIGITAL HOLDINGS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOORE DIGITAL HOLDINGS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED $100 USD.
You agree to indemnify, defend, and hold harmless Moore Digital Holdings LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any wager content you create.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Sections 10–15 of these Terms survive any termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Texas. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you through the App. Your continued use of the App after any changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moore Digital Holdings LLC regarding your use of the App and supersede any prior agreements.
